It's a very limited, but it's when it's necessary to protect the police officer or another from death or great bodily harm. And it requires a use of deadly force to be necessary. And there's some specific factual findings that need to be made, but that is the standard by which we all agreed police are governed. That's a standard that existed on May 25th, 2020. That's the standard that was applied. Now, you may recall, and it was alluded to in opening statement, that the state has charged Mr. Chauvin with felony murder. And they talked about the predicate felony, and that predicate felony being third degree assault, right? Because a person has to commit a felony, and while committing that felony, if someone dies, it's a murder. All right? So the predicate felony is the third degree assault. The question on the third degree assault is whether or not Mr. Floyd sustained substantial bodily harm. Right? That's the question. Is this a third degree assault? Did Mr. Floyd sustain substantial bodily harm? Now, the state is going to present evidence, and they'll have their experts come in, and their experts will say that Mr. Floyd died as a result of asphyxiation, that it was the restraint. That's what they'll say. But we have to remember that this is a trial. This is not a trial of public opinion. This is a trial. And at trial, there's evidence that's presented, and there's cross-examination. And what the defense is going to tell you is that Mr. Floyd died of a combination of a fentanyl overdose, methamphetamines, pre-existing health conditions, and the adrenaline that was coursing through his body. The defense is going to argue that Derek Chauvin was doing what he was trained to do. He was following the policies and procedures of the Minneapolis Police Department. And you will learn that the Minneapolis Police Department trains officers to use their knee in the way that you saw. Now, the state will argue that it was excessive force. And the defense will argue that it was not excessive force. You as a jury will have to decide that. But before you get to that question, you have to decide whether or not the use of force was reasonable. And the defense will put on evidence that the use of force was reasonable under the circumstances. And what are the circumstances? Well, the circumstances are Mr. Floyd was a big man. He was over six feet tall. He was over 200 pounds. He was on drugs. He was resisting arrest. And he was fighting with three police officers. Those are the circumstances. Now, the state will argue that he wasn't resisting arrest, that he was handcuffed, that he was on his stomach, that he couldn't breathe. But the defense will put on evidence that he was resisting arrest, that he was not compliant, and that the officers were justified in continuing to restrain him. Now, the state will argue that Mr. Chauvin used his knee for too long, that he should have stopped at a certain point. But the defense will put on evidence that the officers were waiting for paramedics to arrive, that they were concerned about Mr. Floyd's safety, and that they were following the policies and procedures of the Minneapolis Police Department. So, you as a jury will have to decide whether or not the use of force was reasonable under the circumstances.
